GUARDIAN

An adult appointed to care for a minor child and control that child's property. If the maker of a last will has a spouse who is legally the mother or father of the children, then that maker typically nominates the spouse as guardian. If the maker appoints someone other than the child’s other parent to be guardian, the court will consider the other parent's parental rights, the maker's desires and what is in the best interests of the children.
