5. Pre-Bankruptcy Credit Counseling

Before you can file for bankruptcy, you must first consult a nonprofit credit counseling agency approved by the United States Trustee's Office. This consultation may show you if there are alternatives bankruptcy that would work for you.

You are required to meet with a counseling agency the 6 months before you file your bankruptcy petition. The agency may work with you to create a repayment schedule for your debts. Even if a repayment plan cannot be created, you should receive a certificate from the agency confirming that you have participated in the counseling.

Before your bankruptcy can be completed, you are required to attend a personal finance management class, at the end of which you will receive another certificate.
