Can I file a provisional application for a design patent?
No. The Patent Office has only authorized provisional applications as an initial filing for utility patents. This is due to the considerable time and expense involved in preparing a standard utility patent application. Fortunately, filing for a design patent does not involve as many written steps since the focus of the design’s “description” is the drawings.
