A design patent owner has the right to exclude others from making, using, importing, selling or offering to sell without permission what is protected by the patent – in this case, your unique ornamental design. Enforcement of patent rights may involve filing an infringement suit in federal court.

Once you file a design patent application, you may legally advertise your design as “patent pending” for the period the application is awaiting approval.
