I have been renting an apt.& I have been getting very ill froem mold & My landlord will not allow me to get out of my lease.. If I were you, I would take as many pictures as possible of the water damage and mold if at all possible. I would then go to civil court, if I had to, against the landlord to make him or her to make it right. Judge Judy would have a field day with this.
Well i was renting a house and the landlord had sold the house and then told us he gave us a 30 day notice and i never sighned for it or much less saw it...and he said the he gave it to us and so now im without a home and dont know what to do...i have kids and now have to stay with relatives...is there anything i can do? Hi, I signed a 15 month lease and shortly after moving in I got laid off. I wrote the property manager and explained the situation in December 2009. The property manager suggested split payments and I did just that. For the past 6 months I have been paying 2 payments a month for my rent. Well, the property manager got fired on 6/16 and mew property manager served me a 3 day notice. I told her I would be in to discuss my situation and pay schedule.
That afternoon I went in gave a pay schedule like I had been on with the former property manager for the past 6 monhts. I was paying partial every two weeks when i got my unemployment check. The next payment was to be $600 on Wed or Thurs. She said she would run it by the regional mgr. I stopped by the office a little later that day and was told that I had to have $500 in the office on the Tuesday before my check came. I said "she can't work with me one day for $600 on Wed?" She said those were the orders.
I stopped in on Tuesday afternoon to say I would have $600 on Wed and they had already sent my file to the attorney.
Now I had to pay the past due totally...$1125 and attorney fees to keep my place.
Question: Can I be evicted if they had accepted partial payments for 6 months, basically the "Presumption of Acceptance" comes into play, doesn't it?
Also, they told me they applied the monies I gave them to late fees of approximately $700.00. If I cannot use the "Presumption of Acceptance", do I have to come up with the past due including the late fees?
I want to stay in my apartment and want to work out a new payment plan. If the regional mgr would have just waited one more day....

I am living in an apartment and would like to know if a tenant can withhold rent if the apartment is falling apart, the ceiling has a huge hole in it that they put there and said it would be fixed over a month ago, the toilet over flowed and it took them over 2 months to fix, my dishwasher leaks horribly and have told them every month for almost a year, the carpets have been wet and they just let them be told me to vacuum it up and there is mold growing in our walls they have seen all this and have yet to fix it, i dont know what to do or how to get it fixed, i have pictures of it all and have documented every time i have called and told them,

Repair each problem yourself, then inform the landlord that you're taking the cost out of the rent...
also be aware that if everything is repaired at your landlords expense he/she might eventually go up on the rent so you have to keep that in mind too.
I feel I am being discriminated against because of my service dog at a rental apartment complex. I live in Arkansas.

With family ,when my Mom was alive we only paid 800.00 as soon as she died 4years ago he goes up every so often until we now pay half of his mortgage ,my aunt who rents out 2 rooms in his apartment not including a kitchen pays his other half 1300.00
It took my landlord 11 months to give me my copy of my lease, even when i constantly asked for it, even threatened with legal action i didn't get it. I only got it because i refused to pay the last month of my rent because he has my deposit. Is there a law on providing the tenant with his copy of the lease in a certain time frame?

I just moved into an apartment and I love it, its very beautiful and the surrounding area around my apartment is pretty good, but theirs some tenants that looks (looks like) they do drugs, so the landlord been keeping an eye on them, by putting the neighbor across the street to keep a watch on the place and she is a not tenant of our landlord.

I moved into my apartment on October 4, 2010. I signed the lease on the 2nd. When I was looking at the apartment I informed the leasing agent that I had one 50lb. dog and my daughter, who is 17, had a 15lb. dog. Both of the dogs were under the pound limit for acceptance. In discussing the terms of my lease the agent told me that he would waive the pet deposit fee, so that I could get in their at a reasonable cost. While signing the lease contract with another leasing agent he reminded me that they were waiving the pet deposit fee. I have since been informed of eviction because of pets.

I was renting an apartment for 14 or so months. I started having problems with window mold and water coming in from the roof. I notified the manager and maintence people of the problem. That was in late November and early December. They came and looked at it about a week before Christmas and told me they will be back to "fix" the problem. I waited until the middle of January and then called again. They told me they were going to be there within the week and never showed up. I wrote them a letter telling them that I was going to not pay them $100 off the rent until it got repaired. They told me that it was ok because they havent gottn back to my apartment. Well now I have moved out at the end of April and its the end of July but havent gotten my deposit back... I have pictures and the written agreement about me not paying the 100 dollars but is there anything i can do about the deposit?

Hi, I have been living in a home for almost four months now. A month after we moved in we noticed a musty smell in the master bedroom. I lifted the corner of the carpet back to find Black Mold from a leak in the roof that flows down the inside of the wall. I notified the Landlord and he said he would have someone look at it. Needless to say nobody ever came to look at it. I said something to him two weeks later and he said it was not on his high priority list. We have a three year old boy and a four month old girl. Both of them constantly cough when we are in the house. I stopped paying him rent a month and a half ago until he repairs it. Two days ago we started having electrical problems. There are two fuses in the outside box. The one that is messing up is the one that controls the Refrigerator and A/C and lights in the kids room. All of our food in the freezer and Fridge are ruined. We cant stay there because it is so hot. We contacted him and he was drunk and told us that he was tired of our crap and to pack our **** and he wasn't fixing it. Is there any chance of breaking the lease and getting our security deposit back?

How do you find out the contact number for the actual owners of your apartment? We are having unresolved issues with our apartment manager and we need to find someone higher to talk to. If you rent two people a small mobile home and make a verbal
agreement they can not move in family, and it works for five years, everyone is happy ,then one is sick and they are not able to pay rent, so you agree to wait til they start getting their SOCIAL Security which will be soon. this is a small mobile home and they sneek in 2 adults, and 5 children, do I have a right as a landlord to tell the moochers they have to leave. The reason I ask this question is I had a similalar sitiuation and the police siad I had to serve the moochers with an eviction notice, even though I did not give permission. the place is only for two people and they have 4 adults, 5 children and 4 small dogs.

hello, we lived in a house for 4 and a half years the first year we had a lease and i paid my rent on time every single month then the second year my husband took ill and we was forced to make r monthly payments in weekly payments and we did that for the next 2 years but whenthis happened the landlord never made up a new lease so we only had the lease the first year the next 3 years there was never a lease, then i took ill and we got behind in r payments and the landlord even took r deposit as a months rent so that we could stay there, then all the sudden they wanted us to pay the deposit back they evicted us we moved in 7 days then 6 months later the took us to a magistrate and of course we loss cuz i wasnt represented by an attorney and i wasn t allowed to say a word they knew my situation and how i was struggling financally then they tried to set us up on a payment plan that i could never afford and i told them soo and then i did start to send them small payments and when i say small i mean small i struggled to send them 5 dollars a week payments and they wasnt even cashing the checks so i stopped sending them and 8 months later they r coming after me again and they r goin after my belongings they r starting with my cars, then i guess my personal belongings these people know i dont have the money and they just dont care !!! do i have any rights involing my belongings?? i am fighting for disability and i am in the appeal stages i truely do not have the money i just dont know what to do?thank u very much tina libert
ok i really need help, so this weekend police came to my housse, my sister in law opened the door was scared that there were so many cops and let them in. so my sister in law rents 4 of the rooms in the house and it come with her own living room and kitchen, the rest of the house is divided between me, my husband, my baby in one room, my brother in law in another and mother in law in her room and we also have a family friend that was staying our living room. they searched the entire house never stating the reason they were searching everything. they took our family friend because he had possesion of drugs on him. when they didnt find anything they came to our work place and questioned my brother in law saying that he robbed some house and kept saying that they know he did it, then the questioned my husband, they stated that they were just questioning him because he was near his brother at the time. They took photos of both of them. and stated they will return to my brother in law for further questioning. my question is what can i do? i mean could they really search all our rooms without our consent? and why question my husband if thats not who they were looking for? and is there anything i can do bout my family friend? someone please help

I rented an apartment last month, I moved out within 3 weeks because of mold, roaches, broken toilet, non working garbage disposal, wet moldy carpet and the list goes on and on. property manager could not or would not fix problems, now that I haved land lord is refusing to return my security deposit, and I never got a copy of the lease to sign, so there is no signed lease.
