The Process of Completing a Small Claim
  • Complete our easy online questionnaire.
  • We send a demand letter to the defendant.
    Before you can initiate a lawsuit, you must request payment. Typically, this is done in person, by phone or by mail. For your convenience, LegalZoom will send a Demand Letter to the person you are suing.
  • We prepare your small claims paperwork.
    Once completed, we'll provide you with easy-to-follow instructions on how to submit it to the court.
  • The court sets a date for your small claims hearing.
  • The defendant is notified of the lawsuit.
    LegalZoom will provide detailed instructions on how to properly notify (serve) your defendant.
  • Proof of notification is filed with the court.
    Once the other defendant is served, you must file proof with the court. LegalZoom will provide detailed instructions for filing the proof.
  • Prepare your case for court.

  • Appear in court on the appointed day.
    You may bring witnesses and other evidence to support your case. If the defendant was properly served and does not appear, you will be awarded a default judgment.
  • Collect your judgment.
    If you receive a default judgment or win your case, the defendant will generally have thirty (30) days to pay or file an appeal. Refer to LegalZoom's Collecting Your Judgment Guide for step-by-step instructions on collecting the money you have been awarded.
