3. Comparing Living Trusts and Wills

While living trusts and last wills are both used to distribute property to beneficiaries, there are some important differences. For example, one of the key benefits of a living trust is that it circumvents probate court. Unlike a last will, which can be tied up in probate for years, a living trust quickly and smoothly transfers assets to your beneficiaries. And because a living trust is never registered with the courts, the details of your estate remain private. To see a complete comparison of living trusts and last wills, please click here.

Pour-Over Wills

If you choose to create a living trust, you may also create what is called a pour-over will. It provides for the distribution of any property not included in the trust. It will also allow you to name a guardian for any minor children. The LegalZoom Living Trust includes a pour-over will.
