While living trusts and last wills are both used to
distribute property to beneficiaries, there are some important differences. For
example, one of the key benefits of a living trust is that it circumvents probate
court. Unlike a last will, which can be tied up in probate for years, a living trust
quickly and smoothly transfers assets to your beneficiaries. And because a living
trust is never registered with the courts, the details of your estate remain private.

Pour-Over Wills
If you choose to create a living trust, you may also create what is called a pour-over
will. It provides for the distribution of any property not included in the trust.
It will also allow you to name a guardian for any minor children. The LegalZoom
Living Trust includes a pour-over will.
