Can you legally adopt an adult?

Maybe you finally found that son you've always wanted, but he just so happens to be 35. Or maybe you were reunited with your birth mother and want to make her your official, legal mom. But adoption is just for babies and little kids, right? Who has a brand new daughter that's over 21? Regardless of what you think, it is both legal and possible to adopt yourself a healthy, bouncing grownup. In many cases, your new, adult family member must simply be a legal adult and voluntarily agree to the adoption.

 

Why adopt an adult?

Adoption is the same legal process whether the individual is a child or an adult. The court issues a new birth certificate for the adopted individual and any existing legal relationships with biological or custodial parents are severed. The adopted adult can change his or her last name, also called a surname change, and all adoption records will be sealed.

The most common reason to adopt an adult is for inheritance purposes. In this case, adult adoption allows someone to leave property or financial assets to the adopted individual more easily.

The second reason, almost as common, is to formalize an existing parent/child relationship. For example, parents can adopt a now adult foster child or stepchild. Adult adoption is a popular option for biological parents as well as for children who find their birth family and wish to be formally acknowledged or fathers who find children they didn't know they had.

Finally, adult adoptions often occur to provide perpetual care for an adult who has a diminished capacity or disability. Such adult adoptions can assume responsibility for a mentally retarded or challenged individual or someone who is physically disabled. Through the adoption process, one adult can become the responsible party and decisionmaker for another adult's care.

Guidelines and Requirements Vary

Guidelines and requirements for adult adoptions vary between states. If you're considering an adult adoption, check with your Secretary of State. Many states require formal notification of birth parents. Some require the adopted party to be of diminished capacity while others only need an agreement between the parties involved. If the adult up for adoption is married, some states will want to have the consent of the adopted person's spouse.

Why are some applications rejected?

Interestingly, adult adoptions are not always granted. Many are rejected because of a preexisting sexual relationship between the two parties, preventing same sex couples from gaining rights over one another. Since the courts are formalizing the relationship of parent and child; hence, any sexual relationship will prohibit the adoption.

Age differences might also can halt a proposed adult adoption. In most states, restrictions exist that require the adopting party to be older than the person adopted.

Any suspected fraud will stop an adult adoption in its tracks. Fraud - alleged or real - could include someone asking a wealthy individual to adopt him or her in order to inherit property. If the adopting party doesn't fully consent or understand the act, the courts will likely suspect fraud. Fraud can also relate to insurance, property, or marital issues.

Hi Dianne. I am in the process of being adopted as well. I hope things will work out ok. Well answering to your question. There are 26 states that allow adult adoptions but I dont believe that NJ is one of those. So if you want to be adopted, your step-parents will need to be resident of one of the 26 states that allow it. Getting resident from another state is not that hard. I think that they will only need to live in that state for about six months. Good luck to you.

I have a son who left my household at age 14 to live with his father and stepmother. He does not remember me and would not recognize me if he met me on the street.
Can I argue, that for purposes of inheritance, that this child is no longer mine?
Do I have to include him in my estate plans?
Am I forced to recognize his children as my grandchildren?
His stepmother refuses to adopt him to keep his claim on my family.

There must be a way out of this!

How dare people have children and then feel that they can just discard them like trash. Shame on you for calling this child your son. Its no wonder he left you to live with his father and stepmother.

I hope you do not find "a way out of this" and that this child ultimately inherits everything you have.

And if his father and stepmother are reading this I hope they take you for every cent of child support that they can!

This made me sick. How can someone be like that? How can you not want your child in your life. I seriously hope you never find a wy out of this and they take everything you have.

After reading this i have to say, dont be so quick to judge. I have a stepson with a similair situation, he left our care at age 14, against our will. In short, his father passed away and he was manipulated into to staying with his stepmother...who by the way, recieved his ss benefits until his 19th birthday.

My stepson was unfortunately manipulated, he was turned against us for no logical reason. Our attorney, dcf and even judges involved in our two year battle where baffled by his obviously bad decisions and were frustrated by the fact that state law, at age 14 gave him the right of choice of guardian.

Since that time, numerous attempts to restart our relationship with...sometimes initiated by him and sometimes by us...all ended in dismall failures. It has resulted in incredible emotional pain for our family.

He is know an adult, fully capable of making his own decisions...we can no longer blame the aweful person who took him away for his actions. He continues to act hurtfully towards us.

Before you condem the above poster, i will tell you, a child CAN go to far and there are circumstances that do justify actions of the above poster. Walk a mile in someone elses shoes before you hop on your pompous throne.

reading the article about the mother that wants to dis-own and dis-inherit her son really hits home. my brother's and i suffered through some horrible things in our lives; divorce, loss of a brother and half brother and now our father Sarkis. in 2010, my disgruntled and selfish biological mother announced at my older brother's wedding, that she was disinheriting her remaining living three sons and leaving whatever estate she thinks she might have to my late brother's surviving wife. she gave no reason.
in some ways my father in his last days was not much better. he remarried 20+ years ago, so when he died his entire estate was left to my step mother and half sister. i don't think he did that on purpose, but he knew it would happen. the good news is that i have a strong relationship with my step mother, but i'm not her son legally even though she generally treats me that way.
should i seek adult adoption of me by her, then i wonder what happens to my brothers and i? while i think its healthy for she and i to have a stronger bond and for that bond to translate to my minor child, i wonder what happens to my overall relation to my brothers and my nephew and niece?
ultimately, my biological mother has been filled with hatred of at least three of her sons for all time. that hatred likely stems from some kind of mental illness, but i'd like to separate from her for all time. am i wrong? she has done more to hurt me in the last 30 years than i care to mention. and all i want is to be left alone by her. maybe adult adoption will do it? -Chris

go to your local courthouse and it shouldn't cost more than $50. anyone charging more, who is not affiliated with the government is probably an illigitimate source.

My step-daughter is 21, her mother and I never legeally married but lived together for over 10 years and are still friends. My step-daughter never knew her father. We are not doing it for money or anything like that, we are doing it because we are family and want to make it legeal. The love of a child (adlut or not) and a parent is something that this world can never have enough of.

We live in Arizona, which does not allow adult adoptions over age 21. I have a 23-year old man that aged out of the foster care system, never having been adopted, whose mother was murdered when he was 6. There never was a father in the biological family - he doesn't even know who that was, nor does anyone else.

We have just assumed the relationship of father/son (I'm 50). I'm totally committed to him but wondering what I should look out for. While it would have been great to have been able to legally adopt him, can't a system similar to what same-sex couples have to work with accomplish much of the same thing? Wills, joint accounts, medical directives, etc.

two adults, unrelated biologically have entered into an adult adoption. Now adoptor is unhappy and wishes to undo adoption. State is Wisconsin in which this adult adoption by woman in late 70s of adult in early 50s took place and approved by court.

I am 19 now. My mom and my step-dad were together since she was pregnant with me. I love my step-dad and think of him only as my dad. I have done research and know that I can have him adopt me as an adult and I am planning to do that.

There are two possibilities for my bio-Dad.

Possible-Bio-Dad-A was always in my life and acted as an uncle but unfortunately he passed away 5 years ago due to cancer.

Possible-Bio-Dad-B I have never met and never had contact from (or anyone from his family until) until a month before I turned 18. He contacted my mom only through legal harassment (a term used by some of the court rulings). We did not do the adopting when I was a minor because Possible-Bio-Dad-B would have fought to not have his rights terminated even though he had no interest in acting as a parent, paying child support, etc.

I am confused. I am 45 years old, living in GA. My biological father agreed to an adoption by my mothers second husband when I was 5 and so my original birth certificate was changed to reflect the adoption. My mother met her third husband, the only person I have ever considered a real father, after I was all grown up. They live in NC. I am terminally ill and DO NOT want to die with the second husbands name on my birth certificate. Once I finally broke down and told my parents how I feel, my dad agreed to adopt meas soon as possible. We are all on very very limited incomes and I do not know if I need to do the whole adoption, or just a name change.I just know that I want to die with my dad's last name on my birth certificate.

from what research i have done u dont necessarly have to get readopted, u do have the option of just changeing your last name of which would be an easier and shorter process than adoption, maybe even more cost efficiant but im not sure about that one. though if ur birth certificate states who your parents are on it & if that really bothers u i would imagine that u will have to be adopted by the desired ppl to change that bit of detail.

Hi there, I'm almost 21 yrs old & am living in the state of pennsylvania.. when i was 18 yrs old i ran into 2 wonderful ppl who run their own business, after chatting for a little while we came to an agreement of me living there for a summer to help with that business _ summer being the busiest season. for me it was an opportunity to get away from my crazy life and for them it was very helpful to have a 3rd hand. 3 yrs later im still here & we have become a tight little family just trying to get by everyday by running this business & ect. recently, with this couple now in their early 50's and having no children, they decided they would like to adopt me so they will have someone to pass the business down to eventually, as well as me having the benifits of going to a college university for free through the wife's connection with this college, & i would also be able to recieve insurance which would be awsum because i am not in the best of condition as i should b for my age. there basicanlly is just one concern i have with going through this whole adoption process, the husband was not born here in America but because he married his wife- an American, hes been able to stay here for a good 10 yrs & will continue to. i was just wondering if his specific situation would cause any kind glitch in the process of adoption??

I just went through the procedure of adopting my biological son, who I gave up for adoption at age 5. I live in Pennsylvania and my son in N.Y. I started with asking a lawyer friend how to proceed. He had me call the bar association. They referred me to a local lawyer, who wanted $1,500 and would not accept my offer of $500, saying she couldn't possibly do it for that. I bought the adoption forms from this site, including the example forms - cost was around $200. It cost $85 in our county to file the fee for court, and a couple months for the date to come around. I, my son, and his mom went to court, answered their simple questions, and it was done for a total cost of under $300.

Curious, as we are all out of other options and this does seem to be a massive long shot. I am a legal resident alien from UK, and brought my daughter to the USA when she was 5. I attempted to include her in my paper work when I filed with my then husband but complications with my case caused her to somehow not be included. After many years, thousands of dollars, attorneys and re submitting the same forms multiple times to INS, she is now 26 and has no status in this country. Could a friend of mine or hers adopt her as an adult and at least enable her to get a drivers license?

It's EASY to adopt an adult, and it isn't always about a "parent-child" relationship either, just like the recent news article about the 48-year-old man adopting his 42-year-old girlfriend.

I'm happily married (33+ years now) and my wife and I have legally adopted our shared and longterm girlfriend, so she is now an official member of our family. Plural marriage may not be legal (yet), but this was our way around it, and now we're all one big happy poly family, and loving it!

I was looking into being legally adopted by my foster parents but didn't want to necessarily make it so my biological mom is not my mom any more. Is there any way to have two sets of parents, biological and adopted? My biological parents would not have any legal authority over me anymore, I am 20 so they don't anyways, but I would like them to not be completely cut out. Is that even possible.

I was present at the birth of my daughter; Laura. Her mother was visiting from Mexico and went into labor at my aunts home in San Diego. She handed the child to me and said keep; America. I had my son a few months earlier and when she handed the girl to me I had to nurse her. My aunt was a midwife and we made sure to take special care in listing the date, time, weight, female and length of the child. On waking the next morning the lady was gone. My aunts landscaper was the father, but we could not contact him for several months. When we did make contact he was not in a position to take care of an infant and asked us to continue caring for her. She graduated from high school in San Diego and has been with us most of her life. When Laura was applyng for college we could not obtain a copy of her birth certificate and found that her father never filed documentation for her.

My niece is living with my husband & I right now & she calls us mom & dad. (her bio mother kicked her out when she was 17 cause my niece wanted to go to school instead of paying for her mother's bills & her bio father molested her & is in prison) Her mother has started attacking me since she moved in with us & has even had the nerve to text my phone & tell my niece right before her 18th bithday that she wished she never had her. I don't understand what type of parent does this. But I want to legal adopt my niece even though she is 18 so she is ot left with whatever bills her mother or father leave her when they pass. When I was 17, after my parents tried everything they could to get me to give up my baby, I wouldn't then they came up with the bright idea,let them adopt him and when I married (he was 5 years old)I could adopt him back, well that didn't happen.....I didn't want to tear up my child because of circumstances.....I have always wanted to adopt my son back, about 2 months ago, I told my son, 49 years old that I wanted to adopt him back, he gave a big nod.....Today, the adoption is final, we went before the best judge yet, the courtroom was cleared, but if people had been in the court room, I don't think there would have been a dry eye.I know I had tears of joy. He has always been my son, but now things are the way they should have been from the start. What a wonderful Christmas present.

If I adopt my adult step-daughter, will her child then be my legal granchild in all respects?
