It is estimated that between 4 and 10 million U.S. citizens live abroad. And, some of these Americans have children in their current home country. Does being born in a foreign country mean these children can never fully enjoy Fourth of July fireworks, the right to vote, or the chance to become President?
Like many things, it depends on the circumstances. Typically, a child born in a foreign country with one U.S. citizen parent is entitled to American citizenship. Of course, Uncle Sam has set up more hoops in some situations than in others. Your local embassy or consulate is the best resource for answers about this bureaucratic circus.
And for those of you who think you aren't affected by the information that follows, consider that you just may find be enjoying a nice overseas vacation when your new diaper-wearing traveling companion decides to join you.
First, let's start off with a quick lesson on U.S. citizenship. America follows the English common law rule of "right of soil." In short, citizenship is determined by one's place of birth. As such, those born in the U.S. or its territories (like Puerto Rico, the Virgin Islands and Guam), are American citizens regardless of their parents' citizenship status.
What you might not know is the borders for citizenship. Those born within U.S. ports and harbors or within 12 nautical miles of U.S. borders are also American citizens. Even babies born on planes flying over the U.S. or its territories acquire U.S. citizenship. The ship or plane's country of origin makes no difference regarding citizenship.
However, U.S. installations in foreign countries are not considered part of the United States. So, delivering a baby at a U.S. naval base or embassy in a foreign country does not entitle the baby to U.S. citizenship.
Although the "citizenship by birth" rules have been complex, the February 2001 Child Citizenship Act (CCA) simplified the process. Now, a child who is under the age of 18, was born outside the U.S., and has at least one U.S. citizen parent automatically acquires U.S. citizenship upon entry into the country as an immigrant. No further paperwork is necessary. The parent may request a Certificate of Citizenship and U.S. Passport for the child if proof of the baby's American-ness is desired.
But this process only applies to children permanently residing in the U.S. If the child is under 18, was born outside the United States, but lives abroad in the physical and legal custody of a U.S. citizen parent or U.S. citizen grandparent, the parent or grandparent must apply for naturalization of the child. In addition, more criteria must be met.
The U.S. citizen parent or grandparent must have been physically present in the U.S. for five years before the child's birth, at least two of which were after age fourteen. Further, the child must be temporarily present in the U.S. for the naturalization process and to recite the oath of allegiance. Of course, if the child is too young to understand the oath, this requirement may be waived.
At this naturalization ceremony, the foreign-born, foreign-resident babies gain not only a certificate of citizenship but also membership into an exclusive club. The Constitution rules that only "natural born" citizens can hold our highest office, so it seems these new Americans won't grow up to be President either. The regulations suggest parents who contemplate baby's future run for the White House may want to consider permanent residence in the United States after the birth of little George or Hilary.
As with other areas of immigration and naturalization in this post-9/11 world, the guidelines change often. As such, these rules only apply to those children born on or after the effective date of the CCA. The law in place at the time of the child's birth governs immigration, so research carefully.
If you are expecting a child abroad and want to be sure of your baby's citizenship, check with your local embassy for the latest laws. In any case, you should register your child's birth with the embassy as soon as possible as the first step in establishing your child's claim to U.S. citizenship at birth.
Also, you'll be on your way to making sure you and your child can wave the Stars and Stripes next Fourth of July, vote together when the little one is 18, and perhaps, if you've thought ahead, tread the campaign trail.

My husband was a solider in germany.(before he ever met me lol) He got stationed back state side before the baby was born. She was born in germany to her german mother. I lived in the UAE during the '80s and several friends had children while there. The procedure is to contact the US Consulate (surely now in Dubai as well as Abu Dhabi). The process is simple for people with US passport who are temporarily in UAE. Me and my fiancee are having some problems with getting married in Romania , and that is because he was born at a naval base in the philippines but as the child of one american citizen , and was given an american report of bith abroad from the consulat there...the problem is , that the people at the city hall here say that he is a philipinno and not an american , so we would have to go through more paper work , even though we recieved an apostile from the state department , they would still say that we would have to ask the phillipino goverment for help..

He probably got you a Certificate of Birth Abroad that was issued by the Dept. of Foreign Services... the State Dept should be able to help you get a copy of it. If they can't, I know that the Consul of the US Embassy in Germany has to sign and stamp that doc too - so you might be able to get some help from them. Mine was signed in Munich - I'm not sure which Embassy your paperwork was processed at, so you'll probably need to find out whether it was at Frankfurt, Berlin, Munich,etc... Also, you should definitely check here http://germany.usembassy.gov/acs/reportofbirthabroad-replacement/ for info on how to request another copy of your certificate here. You can also contact the Embassy in Germany for more info.

Your son, if born in Germany to 2 USA citizens is a USA citizen so long as one of you resided in the USA for 5 years, 2 of which were before the age of 14. You'll need to contact the Dept of State for the details on that. He is NOT a citizen of Germany as they only allow dual citizenship to persons with a German citizen parent or grandparent. If that were the case, he would have to declare before his 23rd birthday.

I am a US Citizen born at Fort Lewis Washington by US parents. I gave birth to 4 children in Mexico, 3 boys and a girl. we now live in the US and two of my dark skinned,brown eyed boys have been held by ICE in Texas. 1 spent 3 days and two nights in County Jail until we could present birth certificate. He had provided his TX Drivers License, but had inverted the last two digits of his social security number. That same day we provided all the documents necessary and after numerous phone calls and only getting an answering machine. i had to drive to Homeland Security Office to get him released. 1 month later last Friday. My oldest was held also in the same town and jail. ICE informed me that all US citizens born abroad with a Social Security number must PROVE legal staus to be in this country. I am irrate and would like to persue a Civil Rights Class Action Suit. Do I have a case if they are racially profiling boys who look like two of my sons? I have a blonde blued boy who has never been asked WHERE he was born.

my niece is an American citizen living in Greece. she was born feb. 29, 1980. she stayed here until 1984. went with her parents to Greece. on 2001 she came here for 22 months to finish her masters at Columbia university. she has a boy 6 years old that became an American citizen when he was 2 by the grandparents. she had her daughter in Greece on April 23, 2010. my niece now is in the united states. she is staying here from April 26, 2011 until we don't know when she will return back to Greece. she has her daughter with her here. i want to know if she can make her daughter American citizen. please let me know and also which forms i need to fill out.

My wife and I Just got our US citizenship by naturalization last week. We have a 7year old daughter and we were told before that we didn't have to apply for her citizenship as she automatically becomes one herself when we obtain ours. We were told that it was optional for us to get her own certificate. Right now we are in the process of applying for a passport. We just learned however that we need a proof of citizenship for our 7year old child. How can we get her a certificate? I have been trying to call USCIS to inquire but only got an automated response. How long does the whole process take?

In order for you to acquire dads citizenship you need to have immigrant status and at leat stayed in the u.s have a green card before you turn 18

I write you today to have you legal advice on my case. I recently divorced from my American wife (born US-Citizen) in mid-June of this year after filling almost a year ago. After I got separated with my ex-wife, I moved to Dubai where I currently work since late 2009. During this 2-year separation, I met with my new wife who is a dual citizen, like myself, of Morocco(born) and the USA(naturalized), and who also happens to have recently divorced from her US born husband.
Last summer (August 2010), while in Morocco, for religious reasons we had to get married to be together (while we were both still separated from our respective soon-to-be-ex-spouses). Last May, we have been blessed with the birth of our first child, here in Dubai.

I have just recently been imfornmed that I am the father of a son in Mexico.
I am a born US citizen.
His mother at the time named someone else on his birth certificate.
He was born with a hip bone problem and has been treated at the Shriners Hospital since birth.
Now after 14 years his Mother contacted me and wants him to have my last name on his birth certificate.
She wants him to be able to receive Social security and allow him to enter the US without any paper work issues.
Would I be opening up a box of issues if he does change his last name to mine?
Am I financially responsible, if so then to what extent.
This is a real big issue as I have been married for 8 years with a son of my own.

If you are married with an american citizen and your children were born in the philippines..they should get automatic citizen through their dad you just need to report it to the embassy and submit evidence/proof of u or dad's citizenship to embassy and get the baby's birth certificate present it to embassy

Hello, I was born in Canada but never lived there. My parents never lived there either. They and I have allways resided in th US. I have been trying to get a passport and my drivers licensce renewed but cannot because I am told I need my fathers birth certificate. My father is dead and I don't know where he was born. I have a nephew born in Germany. His mother is a german citizen, brother ( his father) was station in the Army. My brother left Germany a few months before my nephews birth. My bother informed me of this child immediately on his return to the United States. My family lost contact with his mom when the child was an infant. When I was 18 I moved to the Netherlands, and shortly there-after discovered I was pregnant. I had my child in the Netherlands and he currently resides with his "father" (a Dutch National) in the Netherlands. 8 years have passed and I have since returned to the US and am now trying to get my son back from his "father". Now, being young I did not know about registering my son at the embassy while I was there. was wondering if there is any way to get my birth certificate ever again. i've been trying for about 6yrs now. i was born abroad in Saigon,Vietnam. my father was a U.S. Marine and was stationed into the Vietnam War and met my mother there and then out came my sister and i. we came to the U.S. 2yrs later in 1972 to Portland, Oregon and lived there til July 2004. Then moved to Dallas, TX. Somewhere during the move to Dallas i had lost my birth certificate. and i've tried to contact Oregon and Vietnam. they said there is no way they can issue anything for me without any copy of my ID sent from me. and Vietnam said many files were lost during the Vietnam War.
So i've been living with no ID since my Oregon ID expired March 2006. i couldnt get a TX ID because i didnt have my birth certificate. each year i try to contact people but they give me the same run around. 'go back where you were born or go back where you last had a drivers license' which i've did many times but they give me the same thing. The Funny thing is that its so easy for the police to pull me over and give me a ticket or take me to jail for unpaid tickets even though i dont have any kind of ID. HAHA

I have very curios case.. My mom was born in the philippines by a u.s citizen american soldier and a full blooded filipina in 1948.. My mom found out later on that she automatically acquired citizenship through her american dad and decided to migrate to the u.s when i was 8months old.. I got marry like 2 years ago with a canadian girl,and she just got her green card by been marry to me.. But since I got stationed in fort Riley kansas and we use to live in miami.. Our relationship stared having issues and we havent seen each other since june 2010.. (not a big deal) anyway.. We have been separated since then but still marry (working on the divorce) BUT!!... Last december I whent back to cuba to se my family for first time since I left... And I also saw my 3years relationship girlfriend from when I was living in cuba(the only reason why we broke up was because I had to leave the island) So seen each other again was like no humans words haved been created yet to describe such thing.. So this is what I will like to do (of course I have to get finaly divorced first) but my consern is that in very few I will be deployed overseas,and there is a real consern that I could not come back alive, and I was wandering 1st: (cuz I will be in cuba again in few days) if there is something I could do on the US interest section in havana like taking her and sing some kind of declaration that that is my child-to-be so in case I dont make it while deployed at least my child get the benefit of my cityzenship and the mother and the child get to live in the country I love and fight.for it... I will love to get marry with my cuban sweethart.. But im trap on this marriage and I dont think is going to be fix before I deploy.. Deploiment is right there in the corner...

Hello, I have a question, this article says that someone born in American territory is automatically an American Citizen. My girlfriend, she is daughter of Mexican parents, they gave birth to her in Texas, while in vacation. Does that mean that she is legally an american citizen too? I am a US citizen who was living in S. Korea (a country of non reciprocity). My son was conceived in S. Korea and born in S. Korea. His father is US Army (Retired) and currently in S. Korea working on a US Army Garrison with Department of Defense Contractor. I have documented biological and legal paternity. I am trying to get child support in Colorado (where I now live ) the court said that the state does not have jurisdiction to hand the case due to the Uniform Interstate Family Support Act. The fact that he was born and conceived abroad is causing complications in getting an order established. How does the UIFSA handle children with United States parentage and citizenship who were born abroad if one of the requirements might be conception or birth in one of the 50 US States? Please help.

I was Born aboard to us father in 1963 he cam back 1975 and i can't get help getting my paperwork in order he filed it when he was back seeing his family my birth certifate says he was born in the usa and lived here full time till 1942 and went to WW2 he lived full time till 22 years old in the usa. I can find where he lodge my paper work and need help to be able to stay here with family as some are sick and they are the only family i have thank you.

My mother and father were both born in the US and at the time of my birth my dad was attending school in Canada. He was there only one year for his schooling and came back to the US. With both of my parents original birth certificates I've been told that I stll have to file for citizenship and pay a $600.00 fee and go thru the process of citizenship. if someone is born in mexico but was brought here by their parents illegaly and was raised in america since they were a child. they finished high school and do not have any criminal background. now they are an adult with very little money and want to be independant. shouldnt they deserve to be a citizen? living here since six years old to now twenty two and have a child\children born here.

Here's a question from the other side of the fence. I hope you can help answer it: I am Canadian. My son was born 20 years ago, in Canada. His biological father is a US citizen, to whom I was never married. We never lived together, we only dated. Recently, my son't bio-dad informed me that according to his US tax lawyer, my son is AUTOMATICALLY a US citizen, and is in default of several laws as a result. To whit: Failure to register for the Draft on his 18th birthday, failure to register investments over $10,000 with the US tax revenue agency and failure to file US tax returns for the last several years. Naturally I was horrified by this, but I am also highly sceptical. I cannot fathom that the US arbitrarily imposes citizenship on people who have not actively sought it. All the information I've found on the internet assumes the child in question is under 18, and that his/her parents actually want to obtain US citizenship for the child. In our case, neither condition applies; he is already an adult, and he does not want US citizenship, even a dual citizenship. So, the question is: IS MY SON A US CITIZEN, EVEN THOUGH HE HAS NO DESIRE TO BECOME ONE, AND EVEN THOUGH HE HAS NOT APPLIED TO BECOME ONE?? I was born overseas and my father was serving as a Peace Corp volunteer. Him and my mother were married and at 3 months old we entered into the US and I grew up in Maryland. I am now over the age of 18 and am now having issues with citizenship due to this. My son was born in Australia. his father is an American born in Montana. we have lived in the states now since he was 2 years old, he is now 25. he was told he has to prove he is a US citizen in order to get a driver's license, although he came over here to the states with an American passport, how can we show proof that he has had a US passport, which lost now. he did have a copy of birth certificate of US citizens born abroad, but thats lost too. can he help us get a copy of the certificate of children born aboard of US citizen and copy of proof that he has a had US passport?
