Small Claims FAQs

What is the cost of filing a small claim?
Small claims court fees vary, but filing a case against one defendant often costs $25 to $50. Sometimes there is a surcharge for additional defendants. You can contact your local court for the exact fee.

In states where LegalZoom files your claim with the courts, the court filing fee will be added to the total cost. Otherwise, you will be responsible for paying court fees directly when you file. If you win your case, the judge will often add court costs to the judgment total.

If you incur additional expenses trying to collect your money (see Collecting Your Judgment), you're entitled to collect these costs and perhaps interest on the judgment.
