Declarations of Continued Use must be filed between the 5th and 6th year following your trademark registration.
One must also be filed between your registration's 9-year and 10-year anniversaries. After the second filing, Section 8 Declarations come due every 10 years, coinciding with the date of a trademark's Section 9 renewal. For this reason, it is recommended that the Combined Section 8 Declaration of Use/Application for Renewal be used at each successive renewal.
