Becoming American: Understanding legal and illegal immigration

The United States is one hot destination. Whether the lure is Hollywood, the Statue of Liberty or the world's highest standard of living, people pour over American borders every day, searching for a better life. To do either, every one of these people is legally required to have a visa, issued by the United States Department of State. If someone comes to the United States without a visa, or stays after his or her visa is expired, that person is breaking the law.

Visas issued

Two types of visas are issued by the U.S. government - immigrant and non-immigrant. Those holding immigrant visas usually go on to become resident aliens or legal permanent residents, and obtain their green cards. Most immigrants eventually become citizens of the United States. Non-immigrant visas are issued to people who return to their homeland when their trip or schooling is completed, such as tourists or students.

What is an illegal alien?

The Immigration and Nationality Act of 1952 defines an alien as a person who is not a citizen or national of the United States. In other words, an alien is anyone born in a country other than the United States to parents who are not United States citizens.

An illegal alien is someone who is living in the United States illegally; either without the correct legal documentation or by violating the terms of documentation, such as overstaying the time period specified on a tourist or student visa. Illegal aliens have no legal status in the United States. Among other things, illegal immigrants cannot vote, receive social services from federally funded programs, social security benefits, or hold United States passports.

Illegal aliens are subject to detainment and deportation at any time, as are legal aliens if they commit and are convicted of a crime. In many cases however, unless an illegal alien has committed a crime and been convicted, most are not detained or removed from the U.S. simply because they cannot be identified as illegal aliens.

Becoming a naturalized citizen

The process of becoming a United States citizen with full citizenship rights is called naturalization. Overseen by the Bureau of Citizenship and Immigration Service (BCIS), there are several ways for aliens to become naturalized. The most common way, used by individuals who hold an immigrant visa, is to obtain legal permanent resident status by residing in the country for a period of five years. During this time, a legal alien may not spend more than six months at once overseas. He or she must be physically present in the country for at least six months of the year for a total minimum of two and a half years.

It is possible to become a permanent legal resident and later, a naturalized citizen through marriage to a United States citizen. In this case, the naturalization period is shortened from five years to three years, provided the couple has been married for at least three years and the spouse is still a citizen of the United States.

Other factors that affect naturalization and eligibility for citizenship include being at least 18 years old, possessing good moral character and basic reading and writing skills. Potential citizens are required to understand United States government and history, although there are some age-related exceptions to the latter two.

After the application and interview process is completed, the BCIS will grant or deny citizenship to the individual who has applied. If the BCIS needs more information before a decision can be made, it will continue the case. Individuals who have been denied citizenship may appeal.

This country was built on the strength of its immigrant population. While the face of the American immigrant has changed and will change over the years, one thing remains the same: you can enter just as long as you have the correct paperwork and can follow the State Department's rules.

I am married to someone that has lived and worked in the US for 17+ years (age is about 35), but is illegal. We have a year old child and have been married for almost 3 years. What options, besides moving back to Mexico for 10+ years, do we have for getting legal status in the US?

this is what i thinkyou can do. do not let anybody know that you are here illegally and where your husband is working. 2nd: wait for your son to turn 21 and then he can file your guys paper. the other thing is, look if you guys can qualify fo file through his job.... do you have any relatives or his relatives that are citizens?

That is not a great advice. If your husband doen't have an I94, then, it's irrelevant how long he's been here; he'll have to return to his country of origin to start processing his papers.

immigrations law change every day a lawyer is not always going to tell you the truth a lot of them are just out for ur money,do your research good theres so many laws that have loop holes that can help you. Because laws can be interpreted in many ways you can always fight your case. I had a friend that was told he basically had no chance of staying in this country, he fought his case which is one of the most difficult ones to fight 212(h) and he won even thought many lawyers had told him he had no case. How can an illegal alien obtain legal status in the US without marriage or deportation? The people I know were conned by a con artist at the sum of 25K US and when they reported it to Immigration they wanted to deport this family since they did not catch the real criminal posing as an Immigration Offical. What are their options? They speak English and write it well enough that I can understand them, they understand our government structure and process, they hold no allegence to any other country or government other than the US, they do not wish to use any public assistance programs and are willing to hold a Civil and some a military position in the US, they are hard working people and have commited no other crimes. The Immigration office failed to assist them in obtaining replacement documents prior to their expiration. The con artist took these social security cards of these people to make so called copies for documentation. Surely the immigration office can work with the Social Security office to see if their Visas, SS cards and other stolen documents are being used. These people initally came here legally. Dont we have the responsibility to protect those who come here legally from those entering illegally and committing such crimes?

Get your facts straight- you can't use a fake social security card to get welfare. They also can not live in Hud housing. It doesn't happen-non profits and churches may help. Students in some states can go to college but must pay an out of state tuition- this is often difficult for immigrants who don't make enough money- Bills are being presented to prohibit undocumented immigrants from going at all. ignorance is not bliss.

Wrong, govts check numbers and names before assistance is given, their children born here are considered citizens and are able to receive assistance. These illegals do however PAY taxes with their fake numbers they give their employers who do not check numbers and names, are notified of the conflict at the end of the year when taxes are reported and the IRS and the employers look the other way. This is a fact I know from experience. My ex-husband payed over 5,000 every year in fed taxes almost 3,000 in state, and I don't remember how much to soc sec and medicare. He will never see this money nor will I or any of his dependents. That's why immigration is an issue only during election year. They pretend like it's abig deal and they are going to fix it, but if you have 2.5 million illegals paying 5,000 a year to your budget would you send them all packing? Seriously.That's 12.5 billion a year.Guess who is going to pay that to make up the difference in the budget if they ever do send them all back? We citizens, the govt isn't going to take a pay cut. Our economy would collapse and the govt knows this that's why they are still here. People are ignorant to believe what they hear and not research the facts for themselves.

Illegal aliens can get some benefits but only under certain circumstances. They Can NOT use fake Social Security Numbers. They Work and Give up a portion of their check every Paycheck Just Like Everyone else. And They will not be getting that money back. They work hard to survive in this country. Do the best they can do for their famiy. Working sometimes 2 jobs with no days off.There are many american citizens cheating the system. I Know a lot of them. FYI, illegal aliens pay taxes too. My gf's an illegal alien, and she pays taxes. I would know so, she's my gf. Instead of having a social security, they have this thing called a TIN aka Tax Identification Number. They pay taxes just like we do. So calm down man. Most illegals didn't choose to live this way. It's their parents' doing.

EXACTLY,my bf is only illegal by his mother's fault. She brought him here and decided to stay and his Visa expired when his was still a kid, and she didn't do a thing about it. So now he's 18 and he's scrambling to figure out what to do for naturalization! He definitely wouldn't choose to have it this way!

Illegal aliens do and can recieve welfare, under certain circumstances. The only reason I know is if there are pregnant. This is a known fact because i work in the medical field. Public assistance as we call it, and welfare as you call it covers a pregnant illegal immigrant up to 2 months after delivery. So please you get your facts straight.

The pregnant mother is getting medical attention for two months because the baby is a citizen. So actually the illegal mother is not coverd.

The only thing a pregnant illegal women can get is medical assistance. They don't receive Food Stamps or Cash Assistance. They only get help to be able to see a doctor during the pregnancy so that they baby will be born healthy. Once that baby is born it is taken away. Also, it has limitation.

My niece just had a baby in Sept, and her pregnancy nor delivery was covered in any way, she has medical bills coming out of her rear end, but her son however, was covered from beginning to end, he was born at 1 lb 4 oz, 14 inches long, he was in the NIC unit until the end of december, he was covered for everything like i said but not her, down to every Tylenol she was given!

I think you should get YOUR facts straight! Illegal Aliens are dropping ANCHOR BABIES every day here in The USA and when that happens, they get ALL of the benefits, that they did not pay taxes for like Citizens. They are reaping the American tax payers hard earned money for years!

If the system would let them become legal then they would pay taxes and you wouldnt have any right to call their chidren anchor babies and think they are taking advantage of the system. Also a child who is a citizen does not guarantee the parents from deportation.

Way off base. Illegal Aliens that are paying taxes are only paying taxes in the hopes of becoming legal. Applying for government help for our children kills our chances. We hope that by proving that we can earn an income, pay taxes, and raise our children on our own the USA will eventually grant us citizenship.

There have been numerous news reports of illegal immigrants receiving the Earned Income Tax Credit (which they are not eligible for) which pays them up to 40% of their reported income. In fact it is estimated by the IRS that up to 20% of the $44 billion paid out each year is fraudulently obtained.
Any parent of any child under 18 regardless of the child's status is eligible for SNAP, WIC, Medicaid, and Section 8 vouchers. There is even a special program called Emergency Medicaid for pregnant women who otherwise would not qualify for Medicaid. In fact the policies are so loosely monitored that anywhere along the border, it is normal to see the children streaming across the international bridges every morning to attend US schools. It is normal for pregnant women to come to the US for their medical care because in the US it is free and in Mexico they would have to pay $200. All they need is a utility statement which is easy to forge and readily available for purchase for just a few dollars.

No, illegal immigrants cannot receive welfare; however, they DO receive a "free" education. Here in Texas, the school systems MUST take ANY child, regardless of where the child's birth certificate originates. Where I taught, there were at least two bilingual classes per grade level. At my school ALONE, tax payers were paying over $700,000 in teachers' salaries. Most of these kids had parents who are here illegally. I do not know what the solution is, but educating illegals is costing taxpayers hundreds of millions in Texas.

There is no doubt that it is unfair to US citizens for the illegals to benefit from the the money US citizens worked so hard to pay taxes for this Country to run smoothly as possible. The Americans are benefiting from these so called illegals by using them for cheap labors which at times leads to abuse, they do pay taxes each time they make a purchase, many of them have been given a number so they can pay taxes. Illegals help stimulate the economy that creates jobs also for Americans.

These so called anchored babies makes American population bigger more powerful, many of them become part of military defense. Look at China is becoming so powerful maybe even more than the US because they are using their country and large population engage in commercial activities. This is what US government is very much aware of what illegals mean to this country.

The best thing for the US Government to do is allow these illegals to become legal, here to stay & secure the border, they have adapted the American culture already anyway. The fact is they are related to a lot of Americans, these will act on their behalf if they need to, this country can face another division that will affect the strength Americans have today. One of the benefits, taxes will come in to pay for Social Security for the retired Americans.

I would for those who came here with a visa and you passed the time, you can simply meet someone and get married to them so you can gain your status, also get a lawyer if ur not sure but know who you're doing it with. This is a terrible reason to become a nurse. If your heart isn't in it, you will be wasting valuable time and money. I am all for people becoming legal but advising someone to join an emotionally and physically challenging workforce of nursing just to become legal is crazy talk. Not only for the person wanting to become legal but also the future patients. DO NOT follow the previous person's advice unless you have the passion and know in your heart that nursing is what you are sure you want.

Wait at least 6 months into your marriage and then meet with a lawyer to start on your immigration papers. Get them done asap because your life is gonna be so much easier. with your husbands legal status he can get you the benefits and you can become legal as soon as 6 months.

My daughter is an 18 year old US citizen. She has begun to date a 20 year old male from Pakistan. His parents never extended their visa and therefore he is here illegally. They want to get married, but I do not want them to. The only reason they want to get married is due to the Pakistani culture in that they are not allowed to touch each other, other than to hug unless they are married. I am 22 I've been here since I was 3 my boyfriend is 23 and he's been here since he was 1. We have a one year old son and we did not have him to use him as an anchor like they say. Well we are both illegal and our son is a citizen, we are barely able to maintain our little family because of being illegal. We both were brought by our parents to the U.S. from Mexico by the way we are both high school graduates. When I turned 16 I found out I was illegal because I wasn't allowed to get a permit to drive, I don't know much of Mexico only what I learned here.

I am a 76 year old British lady who has been here for 9 years on a visitors visa. I own a house and have 2 dogs. I pay for my own health care and take nothing from the system. I have been going back and forth to England every 6 months. I have stayed a month in England each time before returning to the US. The last time I came in they told me I couldn't do this since I was basically living in the US and had to spend more time in England. What can I do besides going illegal which I am considering. Words to those who spread hate towards illegals

There is no doubt that it is unfair to US citizens for the illegals to benefit from the the money US citizens worked so hard to pay taxes for this Country to run smoothly as possible. The fact is when it comes to survival and live a better life & the well God gave them to want to live, illegals goes though detrimental risk to come here because they cannot afford to apply legally to come to US.

The Americans are benefiting from these so called illegals by using them for cheap labors which at times leads to abuse, they do pay taxes each time they make a purchase, many of them have been given a number so they can pay taxes. Illegals help stimulate the economy that creates jobs also for Americans.

These so called anchored babies makes American population bigger more powerful, many of them become part of military defense. Look at China is becoming so powerful maybe even more than the US because they are using their country and large population engage in commercial activities. This is what US government is very much aware of what illegals mean to this country.

The best thing for the US Government to do is allow these illegals to become legal to be able to regulate laws amongst them, here to stay & then secure the border if that is what they want to do, they have adapted the American culture already anyway. The fact is they are related to a lot of Americans, these will act on their behalf if they need to, this country can face another division that will affect the strength Americans have today. One of the benefits, taxes will come in to pay for Social Security for the retired Americans.

if you baby is born here she is legal citizen an she or he has all rights. but you cant become citizen using the baby until he/she is 21 , yes you can put real father name on the birth certificate, yes should be able to get child support for the baby also should not be any probelm

He got laid off before he would apply for H1 VISA. He did not know until now that he lives illegally. but his TN visa would expired August 2013. We would get married soon.

I have a friend who is Mexican, born in Texas, delivered by a midwife 40 yrs ago the youngest in her family.... HI, I am currantly still legally married to a African from the country Ghana, and because of trust issues on my part i left the marriage with telling him . My parents are legal residents and are waiting a few more years in order to take the citizenship test. I came here on a tourist visa but I have been overstaying the time I was allowed for a long time!! They hope that once they become citizens they will be able to make me a legal resident, they have already talked to an immigration lawyer about it and they seem pretty sure it can be done. My biggest concern is that about 5yrs ago I got married to another illegal alien, about a year after we got married I went to jail for domestic violence. I took and completed a rehabilitation class that was ordered by the judge and did not violate my probation in any way. Right now we are thinking about getting a divorce and I wonder if having gone to jail for domestic violence can affect my chances of becoming a legal resident and joinin the Marines.

hello everyone, Im 23 years old and i have been here (USA) almost an 10 years now. My parents brought my sister and me here for vacation. I have been here since I was 10 years old but my process has taken way to long, and I am 28 years old now. I went to college for 2 years, and I payed all of it using my hard work and effort working a retail job making 10 bucks a hour. I am smart and capable of getting a good job but the process of becoming citizen is really long, and I wish my parents would of stayed in their own country. I don't mind trying another country and living their depends on the opportunity. I want to try canada but I think you got to be self employed or have your own business to get a visa. So my goal is to become self employed and move to canada get a citizenship and come back to united states because my bro is going to turn 21 in 3 years, and he is citizen so he can apply for me. The problem with immigration is that they don't want to help you get out of the united states. They just want you to get out. You can't just move to a country you don't know nothing about. What you can do for people that are immigrates is give them an option to go back by providing education and scholarships to immigrates. It is painful for me to live in a country that was made out of immigrates and they want to kick them out like the Indians.

Hello, I have a question regarding an illegal immigrant that has been living and working in the united states for about 8 years. She is undocumented but also has been paying her taxes. My question is -- what is the best way for her to begin her path to naturalization and citizenship? There is a great fear that coming forward would get her thrown out of the country. What are this person's options to stay? Marriage is not one of the options. Thank you.

My dad bought me to this country at 12 years old. I went to school here until high school but did not graduated. My dad got married and have his papers done but he and his wife couldn't helped, Because i was 26 years old. So i had to lived with them cause i am not able to provide for myself because i lost my job over some immigration issues. I was trying to file for a tax id so i can pay taxes but they asking for so many information i don't have right now. all i have is an updated passport and the legal papers i come into this country with. i recently got married to American citizen and have a baby with her the same year. Is it a way we can have a payment plan or can i Get a sponsor like my dad and step mother to help me if they able to afford it?
