Can my wife and I make a joint will on your site?

Kara B. ∙ October 5, 2018

LegalZoom does not offer a joint will for one major reason: It limits the ability of a surviving spouse to make changes to the will relating to his or her property after the first spouse dies. This restricts his or her ability to manage his or her property after the first spouse passes, especially if the property is specifically given to someone after the surviving spouse dies. Also, a surviving spouse often wants to make changes to the distribution of property as their named beneficiaries get older or other issues arise. This is generally not permitted under a joint will. If you are interested in this type of will, we would encourage you to consult with an attorney.

If you are interested in creating documents for the both of you, we have a special offer that makes it easy for you to create your estate plan. Our Estate Plan Bundle includes additional estate planning documents (Power of Attorney, Living Will) as well as a full year of independent attorney support.
