Although it is not required, most of the states allow testator (person who created the Will) to file his or her Will with the local probate court before death, for the purpose of safeguarding the Will. Generally, after the death, the Last Will and Testament must be filed with the probate court and petition to open probate of the estate is usually done at the same time. It is suggested to contact a local Florida probate attorney before you proceed with a probate court filings to avoid complications.
