Do you recommend setting up the legal sturcture of a business first when it involves a partner, or do you recommend having a working business model/product/service first? I guess this is kind of a chicken before the egg sort of a question...

Starting a business should be like taking a road trip. You follow a course plotted by the GPS or outlined on a map to your end point. Before officially starting a business, you want to plot your course to include things like researching if you have a viable idea, is there a market, how much money is needed for startup and creating a business plan. An excellent free resource is www.sba.gov which has guides to assist you and also counselors. Your LegalZoom membership will provide you with resources for setting up your business and legal advice to assist you with questions.
