The Trademark Statement of Use Process
LegalZoom's Trademark Services make it easy and convenient to file a Statement of Use or Amendment to Allege Use. The following is a detailed
description of our process:
- Complete our online questionnaire and submit a specimen showing the mark as it is used in commerce.
- Next, LegalZoom will review your answers
for spelling, consistency and completeness before completing your Statement of Use / Amendment to Allege Use application. We'll send the completed application to you by e-mail for your electronic signature.
- After we receive your e-signature,
we'll file your application and supporting material with the U.S. Patent and Trademark Office ("USPTO"). We'll also send you an email confirming that we submitted your application.
- The USPTO will email you a confirmation
within a couple of weeks, after it receives your renewal application from us.
- If you already received a Notice of Allowance from the USPTO,
your examining attorney will review your Statement of Use application. If your application is approved, the attorney will issue you a registration certificate. If your original Intent-To-Use trademark application has not yet been approved for publication by the examining attorney, your application will technically be called an "Amendment to Allege Use" and will be reviewed at the same time as your application, approximately six (6) months after the original filing date. |
