What counts as ‘commercial property’?
A commercial property is any space that’s used mainly for work. So that could be an office, shop, workshop, pub, hotel or storage depot – if work goes on there, it’s a commercial property. Most people also class bare land (often with development potential) as being ‘commercial property’ too.
Can I do my own conveyancing?
To protect themselves, mortgage lenders insist on buyers and sellers using solicitors. So, if you want to get a mortgage on a property, you’ll need to use a conveyancer. If you don’t want a mortgage then yes, you can do your own conveyancing. But it can be a legal minefield – so if you’re not qualified, using a commercial property specialist would be a good choice.
How long will commercial conveyancing take?
It depends on the nature of your proposals. It generally takes 10 to 12 weeks to exchange contracts on a commercial property sale or purchase and change ownership titles. If you’re putting a new lease in place, we estimate 8 to 10 weeks. Obviously, the exact timeframe will depend on your circumstances and how co-operative the other parties and their lawyers are – but we’ll do our best to get you in (or out) reach your end goal as fast as we can.
What are the ‘searches’ that a conveyancer carries out?
We’ll send various enquiries about the property to the appropriate local authorities, such as the local council and the water authority so you’ll know everything you need to before you buy or let. The search results will include things like the planning history of the property and its permitted use, whether the property is connected to mains sewers, whether there is any record of finding out about planned roadworks, checking on drainage and water (so you know where public sewers are), environmental searches (we’ll check for land contamination) and so on. Exactly what we do will depend on the area you’re in.
