The problem is that judges are allowed to interpret the law at all. The laws are made by democratically elected representatives of the people and should be above judges. The will of the people should override all else.
If a law says it is illegal to walk a dog then how can a judge interpret it any other way? If the law was meant for all 'pets' then the law should say that.
This of course means that law makers should be extremely clear an concise with laws that they make.
