Requesting Trademark Statement of Use Extension:
LegalZoom's Trademark Services makes it easy and convenient to file your Statement of Use Extension. The following is a detailed description of our process:
  • Complete our brief online questionnaire.
  • Next, LegalZoom will review your answers
    for completeness and common mistakes before preparing your Statement of Use Extension request. We’ll send the completed documents to you by e-mail for your electronic signature.
  • After we receive your e-signature,
    we’ll file your request with the U.S. Patent and Trademark Office (USPTO). We’ll also send you an email confirming that we submitted your request.
  • The USPTO will email you a confirmation
    within a couple of weeks, after they receive your request.
  • The USPTO's examining attorney will review your request.
    If accepted, the USPTO will approve your extension and send you a confirmation email. Once it is approved, you will have an additional 6 months to submit your Statement of Use. If the attorney has any questions, he or she will send you an Office Action detailing the issue. Office Actions typically require a response from you within 6 months.
  • You can submit multiple extension requests
    for up to 36 months after the USPTO issues its Notice of Allowance (a temporary, conditional approval of your trademark application). To view the date of your Notice of Allowance, visit http://portal.uspto.gov/external/portal/tow and enter your trademark's USPTO Serial Number.
