What is a Statement of Use?
A statement of use (SOU) is a formal document filed with the United States Patent and Trademark Office (USPTO) to show that a trademark is being used in commerce for goods or services. It is required for trademark applications that were initially filed with an "intent-to-use" (ITU) basis.
How much are the filing fees?
The USPTO electronic filing fee for a Statement of Use is $150 per class, effective January 18, 2025. This fee applies to each class of goods or services for which you are filing the statement.
What happens if you do not file a Statement of Use?
If you do not file a Statement of Use (SOU) after a Notice of Allowance, the USPTO will abandon your trademark application, and the mark cannot be registered. If you missed the deadline, you may be able to file a Petition to Revive the application for unintentional delay, but you must do so within specific, strict deadlines and pay the necessary fees. If you cannot revive the application, you will have to file a new one, which forfeits your original filing date.
How do I file a USPTO Statement of Use?
Upload an image showing evidence of your mark being used for your goods or services. Confirm that the mark is in use by the owner or an authorized person acting on their behalf. Provide the first use date anywhere and the first use date in commerce.
When do I file a USPTO Statement of Use?
You need to file the Statement of Use (SOU) within 6 months of the issuance of the Notice of Allowance.
What are the requirements for a Statement of Use?
Images that serve as evidence of mark being in use, declaration by the owner or someone authorized by the owner and dates of first use.
What if I haven’t started using my trademark?
If you have not started using the mark, you can file for an extension—that helps you buy 6 months of time to start using the mark. You can extend your extensions up to 5 times, for a total of 30 months from the date of receiving the Notice of Allowance.
