BEST PHONE CALL IN THE 364.25 DAYS OF 2025
Wow! Being nervous and not knowing exactly which direction to take I went online last night and found LegalZoom. I wasn’t completely sure about it (getting the LLC) and my anxiety kicked in so I backed out of it. My number must have saved anyway in their archive because I received a call this morning. Martha Anguiano called and the encounter with her was just what I needed to encourage me further with my LLC process. She was very polite, knowledgeable and immediately gave me a list of what I can choose from to start. After discussing with her more about my plans she suggested the best start up package for me. Martha was so genuinely enthusiastic about my idea that I felt truly comfortable sharing with her. After getting off the phone my smile and heart expressed the connection that was made even if it’s only for the professionalism she offers as an agent, I’m grateful it was her that called as I stated to her, “I’m not sure how it would have went if it were another agent that called.” (I can be nervous when speaking and studdar my words but she made me feel completely heard and understood) I can only hope and believe the entire Team at LeagalZoom is just as pleasant, knowledgeable and concerned for the customers as she exemplified. If you see this message Martha, thank you so much you’re definitely a Golden Star in this universe. ⭐️✨⭐️ Looking forward to working with you & LegalZoom. Thank You!

How to Conduct an New Mexico Business Search
Before you open a business in New Mexico, make sure your preferred name is available. A business name search helps you choose a compliant name before you file your business formation documents with the New Mexico Secretary of State (SoS).
Key takeaways
Check with the New Mexico Secretary of State to confirm if your chosen business name is available or if it’s already claimed by another company.
LegalZoom’s free business name search is a preliminary check for the availability of your preferred business name with the state.
The Secretary of State may reject your application if your preferred name is too similar or identical to one already in use.
Conduct a comprehensive search before filing your business’ formation documents to reduce your risk of your application being rejected.
Get into the details of a business name search below, and learn more about registering a business in New Mexico.
What is a New Mexico business name search?
A New Mexico business name search is the process of checking with the New Mexico SoS to see what business names are already registered in the state. These searches give you a chance to see if your business name is already being used by another business.
Why these searches are important
The New Mexico SoS will reject applications for business registration if the name you’re using is already registered by another company or is confusingly similar to one already registered. If your application is rejected, you’ll have to start the process over with a new business name. This can delay your ability to open your business and may cost you more money.
Example: If “Albuquerque Metal Works” is already registered with the state, choose something like “Duke City Metal Works” or “505 Metal Fabrication” to help avoid confusion.
Who needs to conduct an New Mexico business name lookup?
Any business planning on operating in the Land of Enchantment should conduct a business name search before registering with the New Mexico SoS. This includes the following business entity types:
Limited liability companies. New Mexico LLCs must include designators such as “LLC,” “L.L.C.,” or “Limited Liability Company” in their names.
Corporations. Corporations in New Mexico should include “Corporation,” "Company," "Incorporated," or an approved abbreviation in their names.
Limited partnerships. Limited partnerships must include “Limited Partnership,” “LP,” “Limited Liability Partnership,” “LLP,” or an approved abbreviation.
Nonprofit organizations. Like for-profit corporations, nonprofits must follow naming guidelines and must register with the state to qualify for nonprofit tax incentives.
General partnerships and sole proprietorships. Though these businesses don’t typically file formation documents under their owners’ names, they may still need to do a business name search if they plan on using a trade name.

What are New Mexico’s business naming rules?
New Mexico law requires that business owners choose names that are distinguishable from others already registered in the state while also including the required entity designators for each business entity type.
Beyond those rules, there are a few prohibited and restricted terms you’ll need to avoid using in your business name.
Avoid using regulated industry terms. Unless your business operates in that regulated industry, you’ll want to avoid using terms like “bank” or “Insurance.”
Don’t include terms that imply an affiliation with the government. Private business names should not include terms that imply that the business is a government agency. Avoid using terms like “government,” “federal,” or “police” in your name.
Avoid names that suggest a purpose that’s outside of your formation documents. The name you choose should align with what your business will do. If it suggests a purpose that doesn’t align with your formation documents, your application will likely be rejected.
Avoid names that suggest illegal purposes. Names should avoid profanity and terms that suggest illegal activities.
A full list of New Mexico’s naming rules can be found in the New Mexico State Statutes.
How to search for an New Mexico business name
Search for a business name before registering with the New Mexico SoS to help ensure that your name is available for use in the state. There are several ways to find out if your name is available.
Use LegalZoom’s business name lookup tool
LegalZoom’s free business name check tool makes checking the New Mexico SoS database of business names easy and fast. Type your preferred business name into the tool, select your business entity type from the drop-down menu, and click “Check Availability.” If your name or something similar to it is registered in the state, the tool will tell you. If nothing comes up, your name is likely available for use in New Mexico.
This instant check is free and gives you a preliminary idea of the availability of your name. You should still search for similar names and consider running state and national trademark searches.
Search New Mexico’s state records
If you need additional information about a business name, you can search directly through the New Mexico Secretary of State database.
Step 1: Go to the search page. You can check for business names registered with the SoS by visiting the New Mexico Business Search page.
Step 2: Select your search filter. You can search for business names by “Starts With,” “Contains,” or “Exact Match.” To see if your name is available, it’s typically a good idea to start your search with the “Contains” filter.
Step 3: Enter your business name. Type your business name into the Entity Name/DBA Name box and complete the reCAPTCHA.
Step 4: Run the search. Once your name is typed in, click the search button.
This search will show you if any businesses are using your preferred name as well as the status of those businesses.
Other New Mexico business name searches you should run
A name check through the New Mexico Secretary of State’s database is a great way to see if your name is available. However, there are other searches you may want to run that give you additional information about businesses in New Mexico.
LegalZoom trademark search
Registering a business name in New York only protects it within state lines. Other businesses in other states can legally use it unless the name is trademarked. LegalZoom’s trademark searches let you see if your business name is already registered with the United States Patent and Trademark Office (USPTO). You have two options.
Use LegalZoom’s free trademark search tool. LegalZoom’s Free Trademark Search checks the USPTO database for names matching your search terms. You can browse the status and class details of each matching result.
Get more detailed information with a comprehensive trademark search. Our Comprehensive Trademark Search executes a full-scope search of existing and pending marks with the USPTO and provides ranked results to help pinpoint potential conflicts. You can select between a federal search and a combined federal, state, and common law search, based on your specific needs.
When you’re ready to register your trademark, turn to LegalZoom’s Premium Trademark Registration service—the #1 trademark filer with the U.S. Patent and Trademark Office. 1
USPTO trademark search
State registration of a business name only protects your business in New Mexico. This means other businesses in other states can use your name without creating legal problems, and a name that's available in your state may still infringe on a national trademark.
A trademark search with the USPTO can help you identify names already in use and trademarked. You can search their Trademark Center database on your own or use one of LegalZoom’s tools.
These searches are essential for core assets, such as:
Your business name
Taglines
Brand-specific symbols
New Mexico trademark search
The New Mexico Secretary of State also lets you search for trademarks registered in the state.
Step 1: Head to the Trademark Search tool. You can find the Secretary of State’s trademark search tool here.
Step 2: Type in your search information. If you know the name of the trademark, the trademark owner, or the file number, you can enter it in the search bar and run the search. However, if you don’t have the full information on file, you can search by trademark description under the advanced search tab.
Step 3: Run the search. Once you’ve entered your information, click the Search button.
The search will pull up trademarks registered in the state. The database is completely separate from the USPTO trademark database. You’ll want to run both searches to make sure your name is available.
New Mexico DBA search
If you plan on using a “doing business as,” sometimes referred to as a DBA or trade name, you’ll want to make sure that name is available for use in New Mexico as well. You can search for a DBA name on the New Mexico Business Search page, just as you would for your preferred business name. If no one has registered that DBA name, it’s likely free to use.
Keep in mind that New Mexico doesn’t require businesses to register DBAs with the Secretary of State or at the local county level. However, if a business is already registered under the name you want to use as your DBA, you’ll likely need to choose a different name.
Domain name search & social media search
Your brand’s identity relies on your business’ online presence, like your domain name and social media accounts. Both are major parts of modern marketing strategies, and a unique online presence can help set your business apart from the competition.
Check availability. Make sure your preferred domain name for your website is available by checking with major domain registrars, like GoDaddy or Namecheap, to see if your preferred name is available as a top-level domain such as .com or .net.
Use search engines. Search for your preferred domain name or any variations you may want to use on major search engines. This includes sites like Google, Bing, Yahoo, and DuckDuckGo.
Browse social media. Check different social media platforms, like Facebook, Instagram, TikTok, and YouTube, for channels that use names similar to or identical to your preferred name.
When your online accounts match your legal business name, customers are less likely to mix your business up with your competitors.

Other ways to find information about New Mexico businesses
Searching for trademarks and business names are likely the most important searches you’ll run before registering your business in the state. However, there are a few other searches you can perform if you need additional information.
Check the Albuquerque Business License & Information Search
The City of Albuquerque has a business license search tool that businesses operating within Albuquerque city limits can use to get more information about active licenses. Any business operating in the city must have a city business license in addition to registering with the state. This search can be helpful if you’re trying to get more information about an existing business, like a contractor, vendor, or service provider you’re thinking of working with.
Review the NM Regulation and Licensing Department database
If you need information about a business in a regulated profession, you can search the New Mexico Regulation and Licensing Department database. This lets you verify the license of an existing business or individual. This type of search can be helpful if you’re considering hiring someone or partnering with a licensed individual.
Employer identification number searches
The New Mexico SoS website does not let you search for companies by employer identification numbers (EINs). However, you may be able to use an EIN to get financial and credit information about a business by using other services.
Third-party services: Companies like Dun & Bradstreet let you search for a company with an EIN for a fee.
Credit bureaus: You can research and identify companies using their EINs through credit bureaus. For example, an Experian Business Credit Report allows you to check a company’s financial and legal standing before partnering with them or using their services.
This type of search is useful when you need to confirm the identity or financial history of a vendor or partner, especially in B2B transactions where you might only have their tax ID for compliance purposes.
What to do after a New Mexico business name lookup
Once you know that your business name is available, you can register your business with the state.
Register your name with the New Mexico Secretary of State by submitting your formation documents, or reserve your name if you’re not ready to register just yet. You can also work with a business formation service like LegalZoom to start your New Mexico business with confidence.
Register trademarks for any logos, slogans, or business names you want to use. LegalZoom’s trademark registration service is the #1 trademark filer by volume with the USPTO. 1
Register an assumed name if you want to run your business with a name that’s different from the one you use to register your company with the state. This can be a good choice if you want to drop “Inc.” or “LLC” from your name. It can also be a good choice if you want to use a name that speaks to what your business does or your brand’s values. LegalZoom’s DBA filing service handles the paperwork for you.

Frequently asked questions
How much does a New Mexico business name search cost?
Searching for a business name in New Mexico using either LegalZoom’s business name search tool or the New Mexico SoS business search portal is free. You can search for as many business names as you want without having to pay a fee.
Can I use a name that’s listed as dissolved or forfeited in New Mexico?
Not necessarily. A dissolved or forfeited entity still exists on the records, and its name may still be protected. Contact the SoS Business Services Division at (505) 827-3600 to find out if a specific name is available. They’ll be able to look at the appropriate records and tell you if a previously registered name is free.
What if my application is rejected by the SoS because my business name is already in use?
In most cases, you’ll need to choose a different name. Keep in mind that you may still be able to use a variation of your preferred name as long as you’re able to make it distinguishable from the one already registered with the state.
Can I find information about sole proprietors through the New Mexico entity search?
No. Sole proprietorships and general partnerships are not registered with the New Mexico SoS and won’t appear in the search results. However, you may be able to find information about sole proprietorships by searching the appropriate business licensing division.
Can I reserve a business name in New Mexico before registering my business with the SoS?
Yes, you can reserve a business name in New Mexico for $20. The reservation lasts for 120 days. If you don’t register your name by the end of that 120-day period, you can either make the name available to others for use or file a new reservation for the name as long as the name is available.
