What is a Request for Extension of Time to file a Statement of Use?
A Request of Extension of Time to File a Statement of Use ("Extension Request") is a sworn statement signed by the owner (or person authorized to sign on behalf of the owner), that states the applicant still intends to use the mark in commerce, but needs additional time to do so and prove it by filing a Statement of Use and specimen.

If granted, the Extension Request gives the applicant 6 months to either:
  • file a Statement of Use; or
  • file another Extension Request.
How many times can I request an extension to file my Statement of Use?
Up to five (5) extensions of 6 months each may be requested. This gives Intent-to-Use applicants a maximum of 36 months (including the initial 6-month period) from the mailing date of their Notice of Allowance (NOA) to file their Statement of Use. If, after all extension periods have expired, no Statement of Use has been filed, the USPTO will deem the application abandoned and will not register the mark. To view the mailing date of your Notice of Allowance, visit https://tsdr.uspto.gov/ and enter the USPTO serial number for your trademark.
What happens if I don't file my Statement of Use or any Extension Request in a timely manner?
If you do not file a Statement of Use or an Extension Request within 6 months of the issuance of your Notice of Allowance, the USPTO will consider your application abandoned.
