BEST PHONE CALL IN THE 364.25 DAYS OF 2025
Wow! Being nervous and not knowing exactly which direction to take I went online last night and found LegalZoom. I wasn’t completely sure about it (getting the LLC) and my anxiety kicked in so I backed out of it. My number must have saved anyway in their archive because I received a call this morning. Martha Anguiano called and the encounter with her was just what I needed to encourage me further with my LLC process. She was very polite, knowledgeable and immediately gave me a list of what I can choose from to start. After discussing with her more about my plans she suggested the best start up package for me. Martha was so genuinely enthusiastic about my idea that I felt truly comfortable sharing with her. After getting off the phone my smile and heart expressed the connection that was made even if it’s only for the professionalism she offers as an agent, I’m grateful it was her that called as I stated to her, “I’m not sure how it would have went if it were another agent that called.” (I can be nervous when speaking and studdar my words but she made me feel completely heard and understood) I can only hope and believe the entire Team at LeagalZoom is just as pleasant, knowledgeable and concerned for the customers as she exemplified. If you see this message Martha, thank you so much you’re definitely a Golden Star in this universe. ⭐️✨⭐️ Looking forward to working with you & LegalZoom. Thank You!

How to Conduct a Kentucky Business Search
Before you open a business in Kentucky, it’s best to make sure your preferred business name is available. A business name search helps you see if your preferred name is available before filing your formation documents with the Kentucky Secretary of State (SoS).
How to Conduct a Kentucky Business Search
Before you open a business in Kentucky, it’s best to make sure your preferred business name is available. A business name search helps you see if your preferred name is available before filing your formation documents with the Kentucky Secretary of State (SoS).
Key takeaways
Check with the Kentucky Secretary of State to confirm if your chosen business name is available or if it’s already claimed by another company.
LegalZoom’s free business name search is a preliminary check for the availability of your preferred business name with the state.
The Secretary of State may reject your application if your preferred name is too similar or identical to one already in use.
Conduct a comprehensive search before filing your business formation documents to reduce your risk of your application being rejected.
Get into the details of a business name search below, and learn more about registering a business in Kentucky.
Why does a Kentucky business name check matter?
In Kentucky, business owners are expected to choose unique or distinguishable names before registering their business with the state. This ensures that your business won’t be confused with another that’s already registered and operating in Kentucky. However, if you don’t run a business name lookup for your Kentucky LLC, corporation, or other business entity type, you risk choosing a name that’s already in use.
If you submit your formation documents to the SoS with a name that’s already in use or one that’s confusingly similar to one already registered in the state, your application will be rejected.
A Kentucky business name search helps you make sure your preferred business name is available. This can reduce the risk of your application being rejected and may help you open your doors faster.
Example: If “Derby State Distillery” is already registered with the Kentucky SoS, choosing a name like “Bluegrass Whiskey” or “Bluegrass Spirits” could help you avoid confusion.
Who needs to conduct a Kentucky business name search?
Any business that plans to operate in Kentucky needs to conduct a business name search before registering with the state. This includes the following business entity types:
Limited liability companies. Kentucky LLCs should run an LLC lookup before registering their businesses. These companies must also include designators such as “LLC,” “L.L.C.,” or “Limited Liability Company” in their names.
Corporations. Corporations in Kentucky should also run a business name search to make sure their names are unique and distinguishable. Corporations should include “Corporation,” "Company," "Incorporated," or an approved abbreviation in their names.
Limited partnerships and limited liability partnerships. Limited partnerships should make sure their business name is available for use in Kentucky before registering and must include “Limited Partnership,” “LP,” “Limited Liability Partnership,” “LLP, or an approved abbreviation.
Nonprofit organizations. Like for-profit corporations, Kentucky nonprofits must follow naming guidelines and register with the state to qualify for nonprofit tax incentives.
General partnerships and sole proprietorships. Though these businesses don’t typically file formation documents under their owners’ names, they may still need to do a business name search if they plan on using a trade name.
A full list of naming requirements can be found in the Kentucky Revised Statutes. You can read more about each of these business types below.

What are Kentucky’s business name requirements?
Kentucky has a few guidelines in place to help businesses choose names that comply with state laws and regulations.
Businesses need to include the appropriate designator in their name. Designators explain what type of business entity you’ve formed. If you form an LLC, corporation, or limited partnership, you’ll need to include the appropriate approved designator in your registered name. You may be able to drop the designator by using a DBA or trade name.
Names must be written in the English alphabet. Kentucky requires that business names use English letters. Your business name may be in a foreign language, but the text must be readable by people in the state who have no knowledge of the other language.
Avoid prohibited words. Kentucky prohibits and restricts certain terms in business names. For example, your name can’t use terms that mislead the public about your business’ purpose and can’t imply that the business is a bank, insurance company, or government agency without authorization.
You can see the full list of prohibited words and restrictions by viewing the Kentucky Business Entity Filing Act.
How to run a Kentucky business name lookup
There are several ways to run a business name search before forming your business in Kentucky.
Use LegalZoom’s name check tool
LegalZoom’s free business name check tool makes checking the Kentucky SoS database of business names easy and fast. Type your preferred business name into the tool, select your business entity type from the drop-down menu, and click “Check Availability.” If your name is registered in the state, the tool will tell you. If nothing comes up, your name is likely available for use in Kentucky.
This instant check is free and gives you a preliminary idea of the availability of your name. You should still search for similar names and consider running state and national trademark searches.
Check the Kentucky Name Availability Search tool
The Kentucky Name Availability Search tool lets you see if your preferred business name is already registered with the SoS. The search looks at names already on file with the state.
Step 1: Go to the Business Entity Search page. The Kentucky SoS lets you search for business entities here.
Step 2: Enter your preferred name. Enter your company name or any name you’re thinking of using for your business into the search bar and click “Search Business Name.”
Step 3: Review the results. If your name is available, you shouldn’t see any results. However, if another business has registered a name that’s similar to or identical to your name, you’ll see results in the search.
Search the Kentucky Secretary of State database
You can also search for business names directly through the Secretary of State’s website.
Step 1: Go to the business name search page. The Kentucky SoS lets you search for businesses by name or by organization number by visiting the Business Entity Search page.
Step 2: Type in the name you’re looking for. The name search tool is simple to use. Just enter your preferred business name into the search box and click the search button.
Step 3: Review the search results. If your preferred business name or one that’s similar to it is on file with the Kentucky SoS, you’ll likely have a few names to review. If the search returns no results, your business name may be available.
This search tool doesn’t guarantee that your business name is available. It can only search for names already registered with the state. If someone else registers your business name before you file your formation documents, you may still need to choose a different name.
Other Kentucky business name searches you should run
Though running a Kentucky business name lookup can help you make sure your business name is available before you register with the state, it only tells you if someone has registered the name in Kentucky. To make sure your business name is completely available, you’ll also want to run these searches.
LegalZoom trademark search
Even if your business name is available in Kentucky, it could still be protected by a national trademark, LegalZoom’s trademark searches let you see if your business name is already registered with the United States Patent and Trademark Office (USPTO). You have two options.
Use LegalZoom’s free trademark search tool. LegalZoom’s Free Trademark Search checks the United States Patent and Trademark Office database for names matching your search terms. You can browse the status and class details of each matching result.
Get more information with a comprehensive trademark search. Our Comprehensive Trademark Search executes a full-scope search of existing and pending marks with the USPTO and provides ranked results to help pinpoint potential conflicts. You can select between a federal search and a combined federal, state, and common law search, based on your specific needs.
With our free trademark lookup tool, you can search as many names as you want. When you’re ready to register your trademark, turn to LegalZoom’s Premium Trademark Registration service—the #1 trademark filer with the U.S. Patent and Trademark Office. 1
USPTO trademark search
State registration of a business name only protects your business in Kentucky. This means other businesses in other states can use your name without creating legal problems. A trademark search with the USPTO can help you identify names already in use and trademarked. You can search their Trademark Center database or use LegalZoom’s free, comprehensive trademark search tool.
Both tools let you search for nationally registered trademarks. If you find that another business is already registered under your preferred name, you can make a change before infringing on their trademark.
These searches are essential for core assets, such as:
Your business name
Taglines
Brand-specific symbols
Kentucky SoS trademark search
Kentucky maintains a searchable database of trademarks registered in the state. These may not be registered on the federal level, and may not appear in the USPTO trademark database.
Step 1: Go to the search page. Head to the Kentucky Trademarks and Service Marks Search page.
Kentucky SoS trade name search
Trade names, sometimes called “doing business as” names, are registered with the Clerk of the Superior Court in the county where the business operates. To search for that trade name, you’ll need to go to the county’s Superior Court website or contact the local court for help with a records search.
Domain name search & social media search
Your brand’s identity relies on your business’ online presence, like your domain name and social media accounts. Both are major parts of modern marketing strategies, and a unique online presence can help set your business apart from the competition.
Check availability. Make sure your preferred domain name for your website is available by checking with major domain registrars, like GoDaddy or Namecheap, to see if your preferred name is available as a top-level domain such as .com or .net.
Use search engines. Search for your preferred domain name or any variations you may want to use on major search engines. This includes sites like Google, Bing, Yahoo, and DuckDuckGo.
Browse social media. Check different social media platforms, like Facebook, Instagram, TikTok, and YouTube, for channels that use names similar to or identical to your preferred name.

Other ways to find information about Kentucky businesses
Business name and trademark searches can help you register with the state, but they’re not the only way to get information about businesses registered in Kentucky.
Employer identification number (EIN) searches
Kentucky does not let you search for companies by employer identification numbers. However, you may be able to use an EIN to get financial and credit information about a business by using other services.
Third-party services: Companies like Dun & Bradstreet let you search for a company with an EIN for a fee.
Credit bureaus: You can research and identify companies using their EINs through credit bureaus. For example, an Experian Business Credit Report allows you to check a company’s financial and legal standing before partnering with them or using their services.
This type of search is useful when you need to confirm the identity or financial history of a vendor or partner, especially in B2B transactions where you might only have their tax ID for compliance purposes.
What to do after a Kentucky business name lookup
Once you know that your business name is available, you can register your business with the state.
Register your name with the Kentucky Secretary of State by submitting your formation documents, or reserve your name if you’re not ready to register just yet. You can also work with a business formation service like LegalZoom to start your Kentucky business with confidence.
Register trademarks for any logos, slogans, or business names you want to use. LegalZoom’s trademark registration service is the #1 trademark filer by volume with the USPTO.
Register a trade name if you want to run your business with a name that’s different from the one you use to register your company with the state. This can be a good choice if you want to drop “Inc” or “LLC” from your name. It can also be a good choice if you decide to change your name or want to use a more colloquial name in public. LegalZoom’s trade name filing service handles the paperwork for you.

Frequently asked questions
Can I call the Kentucky Secretary of State to check name availability?
Yes. The Kentucky SoS Business Division will help you check name availability by phone. Call (502) 564-3490, Monday through Friday, from 8 a.m. to 4 p.m. ET. This is a free service, but note that phone checks are preliminary. The final determination happens when you submit your formation documents.
What's the difference between the Business Entity Search and the Name Availability Search in Kentucky?
The Business Entity Search shows you all registered entities with similar names, which gives you context about what's already out there. The Name Availability Search gives you a direct yes/no answer on whether your specific name is available. Use both. Start with the Business Entity Search to see the landscape, then confirm availability with the Name Availability Search.
Does registering my business in Kentucky protect my name nationally?
No. Kentucky state registration only protects your name within Kentucky. To protect your name nationally, you need a federal trademark registered with the USPTO. LegalZoom's trademark services can help.
What happens if my Kentucky LLC name is rejected after I file?
The Kentucky SoS will notify you and explain why your filing was rejected. You'll need to choose a new name and refile. To avoid this, use both search tools before filing, and call the SoS at (502) 564-3490 if you're uncertain about a name's availability.
Can I use a DBA instead of changing my LLC name in Kentucky?
Yes. If your LLC is already registered but you want to operate under a different name, you can file a Certificate of Assumed Name (DBA) with the Kentucky Secretary of State ($20 fee). This lets you use a different public-facing name without changing your legal LLC name.
